The Canadian government is responsible for the federal administration of the country. As a constitutional monarchy, the Crown serves as the sole agency, with distinct roles in the executive as the Crown-in-Council, the legislature as the Crown-in-Parliament, and the courts as the Crown-on-the-Bench.

Nonetheless, the Privy Council (commonly known as the Cabinet), the Parliament of Canada, and the judiciary are the entities that exercise the powers of the Crown. The term “Government of Canada” can refer to the collective group of all three institutions or, more specifically, to the executive branch, which includes the ministers of the Crown (the Cabinet) and the federal civil service (who are directed by the Cabinet). This executive branch collectively identifies itself as the Government of Canada or, more formally, Her Majesty’s Government.

Both senses of the term “Government of Canada” were established during Confederation through the Constitution Act of 1867, which created a federal constitutional monarchy. The Canadian Crown serves as the foundation and most essential component of its Westminster-style parliamentary democracy.

The Canadian government’s executive, legislative, and judicial branches are all under the umbrella of the Crown. The head of state is Queen Elizabeth II, who is represented by a governor-general (currently Mary Simon). The prime minister, currently Justin Trudeau, leads a government that the Crown invites to form a government after it secures the confidence of the House of Commons. This is typically determined through the election of enough members of a single political party in a federal election to provide a majority of seats in Parliament, forming a governing party.

However, other aspects of governance in Canada are outlined in the rest of the Canadian Constitution. This includes written statutes, court rulings, and unwritten conventions that have developed over centuries.

The Queen’s Privy Council for Canada is the official body that provides advice to the sovereign or their representative on the exercise of executive power. Within the Privy Council, a committee called the Cabinet is primarily responsible for this task. The Cabinet collectively establishes the policies and priorities of the government for the country.

The Government of Canada is composed of the ministers of the Crown and is led by the prime minister. The members of the Cabinet are appointed by the sovereign based on the advice of the prime minister. Conventionally, the members are chosen from the House of Commons or, less frequently, the Senate.

Furthermore, while in office, the government must retain the support of the House of Commons. Certain critical motions, such as the approval of the government’s budget, are regarded as confidence measures.
